21조넷 8개 단체, ‘대통령 풍자 동영상’ 동시 게시 온라인 행동 나서
– “대통령 풍자 동영상 수사는 모든 시민이 언제라도 당할 수 있으며, 한국 사회 표현의 자유를 급격히 위축시킬 공권력 행사”임을 비판하기 위한 목적이라 밝혀
2024년 4월 1일 ‘혐오와 검열에 맞서는 표현의 자유 네트워크(21조넷)’에서 활동하는 8개 단체는 지난 2월 21일 대통령에 대한 명예훼손 혐의로 여당이 고발하여 메타(meta)와 틱톡(TikTok)에서 접속 차단되고, 지금은 제작자와 다수의 게시자를 경찰이 추적 중인 <가상으로 꾸며본 윤대통령 양심고백 연설> 동영상을 각 단체 온라인 계정에 게시했다.
해당 동영상을 게시한 단체들은 해당 동영상의 제작, 게시는 헌법 제21조에서 모든 국민에게 보장하고 있는 ‘표현의 자유’로 당연히 보호받아야 할 행위이며, 이에 대한 방심위의 접속차단 결정과 경찰 수사는 이러한 국민의 표현의 자유를 침해하는 공권력 행사임을 알리려는 목적에서 한 행동이라 밝혔다.
지난 2023년 11월 유엔 자유권위원회(UN Human Rights Committee)는 한국 정부에 명예훼손을 범죄에서 제외할 것을 권고했다. 아울러 위원회는 정부나 기업에 대한 비판적 견해에 대한 형사 기소, 고위 공직자와 선출직 공직자들의 비판 언론에 대한 형사 고소에 우려를 표한 바 있다.
게시 단체들은 해당 동영상이 일반적인 상식과 이해력을 가진 시민이라면 대통령이 실제로 한 발언이라 믿을 가능성이 없기 때문에 풍자로 여길 것이라 설명했다. 풍자는 그 대상에 대한 ‘의견’ 표현일 뿐, 대통령에 대한 ‘허위 사실’ 적시에 해당하지 않기 때문에 명예훼손죄가 성립할 수 없다는 것이다. 따라서 단체들은 경찰이 대통령에 대한 명예훼손을 이유로 동영상 제작자와 다수 게시자들을 형사 고발하고 수사하는 것은 대통령과 정부에 대한 비판의 목소리를 억압하기 위한 반민주적 행태라 비판했다.
동영상을 게시하고 여기에 연대 의사를 밝힌 21조넷 참여 단체들은 이 사건이 단지 동영상 한 건에 해당하는 문제가 아니라고 지적했다. 윤석열 정부 출범 이후 계속되고 있는 언론인과 언론사에 대한 검찰•경찰의 압수수색, 노사 합의를 무시하고 강행된 공영방송 프로그램의 폐지와 진행자 하차, 대통령 참석 행사에서 발언자의 입을 틀어막고 사지를 들어 내쫓은 대통령 경호실의 폭력 등 한국에서 벌어지고 있는 표현과 언론의 자유 탄압이 평범한 시민에게까지 확대된 중대한 사건이라는 것이다.
또한 해당 단체들은 경찰이 동영상 접속차단을 요청한 지 이틀 만에 긴급 심의를 열어 11개 글로벌 플랫폼 사업자에게 접속차단 협조를 구한 방심위가 스스로 심의의 독립성을 저버렸다고 비판했다. 류희림 방심위원장의 취임 이후 위원회가 대통령과 여당에 대한 비판을 봉쇄하는 검열기구로 전락했고, 22대 총선을 맞아 선거방송심의위원회를 통해 언론에 유례 없는 제재조치를 남발하고 있는 상황을 염두에 둔 것이다.
아울러 단체들은 오늘 게시한 동영상에 대해 또다시 방심위가 11개 글로벌 플랫폼 사업자에게 접속차단을 요청할 경우, 해당 플랫폼 사업자에게 이를 이행하지 말 것을 당부했다. 방심위의 시정요구(접속차단) 결정은 이를 그대로 따를 법적 의무가 없으며, 특히 불법정보 심의가 아니라 이번 동영상 차단 결정에 적용된 ‘사회적 혼란 야기’를 이유로 한 유해정보 심의는 더욱 법적 정당성이 없기 때문이다. 따라서 단체들은 방심위의 요청과 무관하게 플랫폼 사업자들은 자체 약관과 콘텐츠 정책에 따라 이용자들의 표현의 자유를 보장해야 한다고 주장했다.
단체들은 무엇보다 이번 동영상 게시 온라인 행동이 지금 수사 중인 동영상 제작자 및 게시자들만의 문제가 아니라, 한국의 모든 시민이 언제라도 당할 수 있고 한국 사회 표현의 자유를 급격히 위축시킬 공권력 행사라는 점을 비판하기 위한 목적임을 분명히 했다. 이를 위해 오늘 동영상을 게시하고 보도자료에 연명한 단체들은 현재 부당한 수사의 피해자인 영상 제작자 및 다수의 게시자들에게 상담 및 도움을 지원하겠다고 밝혔다. 상담은 21조넷 대표 이메일(article21net@naver.com)로 신청하면 된다.

Article 21 Net CSOs Re-publish the President Satire Video
In firm condemnation and solidarity against the investigation into the satirical
video about the president, which gained widespread attention following its release
by a TikToker, we share the same video ourselves.
The government’s abuse of its authority undermines the freedom of
expression of Korean citizens by signaling that anyone can be subjected
to scrutiny at any time and place.
On April 1st, eight organizations within the Coalition for Freedom of Expression (“Article 21 Net”) shared a video on their online platforms. This video, titled “A Fictionalized President Yoon’s Conscientious Confession,” was blocked on February 21st by the KCSC. It quickly went viral on social media but faced accusations from the ruling party for defaming the President, and was blocked on Meta and TikTok. Currently, the creator of the video and numerous other individuals who posted the video on social media are being investigated by the police.
The creation and distribution of the video falls under the protection of “freedom of expression” as stipulated by Article 21 of the Constitution. Therefore, the KCSC’s decision to block access to the videos, along with the police investigation into the creator and its sharers, represents an overreach of government authority, infringing on citizens’ right to free expression.
In November 2023, the UN Human Rights Committee recommended that the South Korean government decriminalize defamation. Additionally, the Committee expressed concerns about legal actions against individuals criticizing the government or businesses, and lawsuits targeting media outlets by high-ranking and elected officials.
The video should be considered satire, given that a reasonable person would likely not perceive it as a factual representation. Furthermore, a satirical video does not amount to defamation as it conveys an “opinion” rather than presenting a “false fact” about President Yoon. Consequently, the police’s criminal charges and investigation of the creator and those sharing the video for defaming President Yoon should be seen as an anti-democratic effort to silence critical voices against the president and his administration.
We also condemn the KCSC for undermining its autonomy by convening an emergency meeting to ask 11 global platform operators to remove the video, following the police’s demands for its takedown, merely two days later. Since Chairman Ryu Hee-rim assumed office, the KCSC has turned into a censorship body to silence criticism against the government and the ruling party. Additionally, the Election and Broadcasting Review Committee, a subordinate organization of the KCSC, is imposing unprecedented penalties on media outlets.
We urge the 11 global platform operators to resist the KCSC’s demand to remove the videos. The KCSC’s directive relies on a vaguely defined clause about information deemed “harmful for causing societal disruption”, which lacks solid legal grounding. Hence, these platforms are not obliged to adhere to the KCSC’s order. We appeal to these platforms to uphold their users’ freedom of expression guided by their respective terms of service and content policies.
Above all, we emphasize that our uploading video is not solely a criticism of the police raids but also a condemnation of the misuse of public power – a threat that any Korean citizen could encounter anywhere and at any time. In a show of unwavering solidarity, we, the organizations that disseminated the video and issued the joint press statement, will provide legal support to the creator and others sharing the content, who are now subjected to an unfair investigation.
