Mission to the Republic of Korea
Summary
The Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression undertook an official mission to the Republic of Korea from 6 to 17 May 2010. In the present report, he provides a brief overview of the political and historical background in the Republic of Korea, and outlines international legal standards and the domestic legal framework on the right to freedom of opinion and expression. In the main section of the report, the Special Rapporteur focuses on the following issues of concern: defamation, freedom of opinion and expression on the Internet, freedom of opinion and expression before elections, freedom of assembly, restrictions on freedom of expression on the basis of national security, freedom of opinion and expression of public officials, independence of the media, and the National Human Rights Commission of Korea.
The Special Rapporteur commends the progress made over the decades in the Republic of Korea as a vibrant democracy, including the attainment of one of the highest broadband Internet penetration in the world. However, the Special Rapporteur expresses his concern that since the candlelight demonstrations of 2008, there have been increased restrictions on individuals’ right to freedom of opinion and expression, primarily due to an increasing number of prosecutions, based on laws that are often not in conformity with international standards, of individuals who express views which are not in agreement with the position of the Government. The Special Rapporteur makes several recommendations on each of the main issues addressed to fully guarantee the right of all individuals to express diverse opinions, both in law and in practice, which would further consolidate the democratic foundations of the Republic of Korea.

유엔 특별보고관은 의사와 표현의 자유에 대한 권리의 증진과 보호에 관한 실태 조사를 위해 2010년 5월 6일~17일까지 대한민국을 공식 방문하였다. 이 보고서는 대한민국의 정치적, 역사적 배경을 대략적으로 기술하고 의사와 표현의 자유에 관한 권리에 대한 국제적인 법적 기준과 국내법 체계를 전반적으로 설명하고 있다. 특별 보고관은 이 보고서의 본문에서, 명예훼손, 인터넷상 의사와 표현의 자유, 선거전 의사와 표현의 자유, 집회의 자유, 국가안보를 근거로 하는 표현의 자유 제한, 공무원의 의사와 표현의 자유, 언론매체의 독립성, 대한민국 국가인권위원회 등에 초점을 두고 있다.
특별 보고관은 전 세계에서 가장 높은 광대역 인터넷 보급률을 달성하는 등 대한민국이 지난 수십 년간 역동적인 민주국가로서 이룩한 성과를 높이 평가한다. 그러나, 특별보고관은 2008년 촛불 시위 이후, 정부의 입장과 일치하지 않는 견해를 밝힌 개인들을 국제적 기준에 일치하지 않는 국내 법규에 근거하여 사법 조치하는 사례가 늘어나는 점을 들어 개인의 의사와 표현의 자유에 관한 권리에 대한 제약이 늘어나고 있음을 우려하고 있다. 특별보고관은 대한민국의 민주적 기반이 더욱 공고해 질 수 있도록, 주요 현안 각각에 대해 모든 개인이 다양한 의견을 표현할 수 있는 권리를 법적으로나 실제적으로 전면 보장할 것을 권고하고 있다.
